Terms of Service

These Terms of Service (“Terms”) govern your purchase and use of website design, hosting, and related services from SMB Web Designer (“we,” “us”). By placing an order or using our services, you agree to these Terms.

1. Services

We design and build small business websites, provide hosting and maintenance, and offer optional add-ons and post-launch services such as SEO, reporting, and site updates. The specific features included in each package are described on our Pricing page and product page at the time of purchase.

2. Orders and Payment

  • The website setup fee is due in full when you place your order.
  • Hosting is billed monthly or annually, in advance, based on the plan you choose.
  • Add-ons and custom work are billed as quoted before work begins.
  • Prices may change, but changes will not affect orders already paid for. We will give at least 30 days’ notice of hosting price changes.

3. Your Responsibilities

You agree to provide accurate business information, content, logos, and images, and to complete your questionnaire and review your preview in a timely manner. You confirm that you own or have permission to use any content you provide, and you are responsible for the accuracy of information published on your website (for example, licenses, prices, and service claims).

4. Timeline and Revisions

Our target turnaround is 3–5 business days after we receive your completed questionnaire and materials. Delays in providing information or feedback will extend the timeline. Your package includes one round of revisions, to be requested within two days of receiving your preview. Additional revisions or changes in scope may be billed separately. If we do not receive feedback within 14 days of sending your preview, we may consider the website approved.

5. Ownership

Once your setup fee is paid in full, you own your website’s content and design as delivered to you. Third-party software, themes, plugins, fonts, and stock images remain subject to their own licenses. We may display your website in our portfolio unless you ask us not to.

6. Hosting and Maintenance

While your hosting plan is active, we host your website, apply security updates, and keep backups. We aim for reliable uptime but cannot guarantee uninterrupted service. You may cancel hosting at any time; if you cancel, your website will go offline at the end of your paid period unless moved to another host. On request, we will provide your site files at no charge; hands-on help moving your site to another host may be quoted separately.

7. Search Engine Results

We set up your website using SEO best practices, but we do not control search engines and cannot guarantee any specific ranking, traffic, or number of leads.

8. Refunds

Refunds are handled according to our Refund and Returns Policy.

9. Acceptable Use

You may not use a website we build or host for illegal content, spam, malware, or content that infringes on others’ rights. We may suspend hosting for websites that violate this section.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim related to our services is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, including lost profits or lost business.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules.
